1. PARTIES

3. LEASE TERM
The lease shall commence on [Lease Start Date] and shall continue on a month-to-month basis thereafter. Either party may terminate this month-to-month tenancy by providing written notice of at least thirty (30) days to the other party. The tenancy shall terminate at the end of the calendar month in which the notice period expires. Rent shall be prorated on a daily basis if the lease begins or ends on a date other than the first or last day of a month.
4. RENT
Tenant(s) shall pay Landlord monthly rent in the amount of $[Monthly Rent], due and payable on the 1st day of each month without demand. Rent shall be considered late if not received by the 6th day of the month (grace period of 5 days). If rent is not paid in full by the 6th day, Tenant shall pay a late fee equal to five percent (5%) of the monthly rent or $[Late Fee Amount], whichever is greater. In the event a check is returned due to insufficient funds (NSF), Tenant shall pay an additional non-sufficient funds fee of $35.00 per occurrence.

5. SECURITY DEPOSIT
Tenant shall deposit with Landlord the sum of $[Security Deposit Amount], representing a security deposit equal to [number] month(s) of rent. The security deposit shall be held in a separate account and shall be returned to Tenant within twenty-one (21) days of lease termination, less any lawful deductions. Landlord may withhold from the security deposit any amounts necessary to cover unpaid rent, damage beyond normal wear and tear, cleaning costs to return the unit to move-in condition, or other lease violations.
