WHAT IS SUBJECT-TO?

A subject-to acquisition means purchasing a property "subject to" the existing mortgage — the deed transfers to the investor but the original loan remains in the seller's name. The investor takes over mortgage payments without formally assuming the loan.
IMPORTANT LEGAL NOTE: Subject-to transactions trigger the "due-on-sale" clause in most mortgages, which gives the lender the right (but not obligation) to call the loan due. Most lenders do not exercise this right when payments are current. Consult a real estate attorney before completing any subject-to transaction.
Subject-to is best for:
  — Sellers who have equity and need immediate relief (foreclosure, hardship)
  — Deals with low-interest assumable-style loans (pre-2022 era rates)
  — Investors who want cash flow without a new loan
  — Sellers who cannot or will not list conventionally
