The investor takes over mortgage payments without formally assuming the loan. IMPORTANT LEGAL NOTE: Subject-to transactions trigger the "due-on-sale" clause in most mortgages, which gives the lender the right (but not obligation) to call the loan due. Most lenders do not exercise this right when payments are current. Consult a real estate attorney before completing any subject-to transaction.
